Mediation
Mediation is an out-of-court procedure that is quite common in Europe, USA and a number of other countries. It is known as useful and necessary instrument of modern legal system. Mediation assumes resolving a conflict by means of inviting not a state judge, but an individual or mediation company who is capable of finding a solution suitable to both parties to argument.
One of the benefits of mediation is continuity of business relationship between the parties, where in court proceedings such relationships are often severed. Then, mediation provides for substantial cost savings when compared to traditional law suits (i.e. court fees, state dues and tariffs, lawyers, etc). In cases where one of the mediated parties is represented by legal staff member, that means substantial time commitment on his or her behalf, which will inevitably lead to interrupted work within the organization.
Mediation is most efficiently used where the court is located far from the organization’s location; for example, in a situation where you are in Vladivostok and your opponent and court are in Moscow. Instead of paying for travel costs of your legal staff member (where the prices for the airfare alone can add up to thousands of dollars), it is wise to involve a local mediator or mediation company.
